Morris Ehrenberg was a Secret Service Agent during World War I, and participated in investigation of persons accused of being Communists during the "Red Scare."  He passed on his firearms training to his grandson, Larry, who passed on these methods to his son, Marcus Melnick, our primary trainer, in 1980.  Since then, Marcus has worked in Law Enforcement and Security, and has added modern safety tactics to the foundation that Agent Ehrenberg laid.

Policies

Cancellation Policy

No refunds are given.  If cancellation is done 48 hours ahead of class, participants can attend a future class.

We are not responsible if the State of Illinois does not issue a CCL permit.  

Student is responsible for disclosing any arrests or a psychiatric hospitalization in the past 5 years.

Waiver

Acknowledgement of Risk

<![if !supportLists]>2.     <![endif]>I am aware that the use of firearms/training activities is a hazardous activity.  I acknowledge that my participation in a firearms or other training course entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death or damage to property or third parties.  The risks include, among other things:  shooting myself or being shot by third parties, suffering hearing loss, injury, or loss of eyesight, inhalation of contact with airborne contaminants or flying debris, falls that can result in injury or death, injury or death from the result of falling objects.  Furthermore, I acknowledge that Melnick Conglomerate instructors have difficult jobs to perform.  I am aware that they seek safety, but they are not infallible.  They might be ignorant of my fitness and abilities.  They may give inadequate warnings or instructions, and the equipment being used may malfunction.  I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of this activity.  My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. 

Release of Liability

<![if !supportLists]>3.     <![endif]>In consideration for being permitted by Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees or one of its affiliated individuals or organizations to participate in these activities, I hereby agree that I, my assignees, heirs, successors, distributes, guardians, legal representatives and any and all other persons or entities who may claim by or through me in any way or manner, voluntarily release liability and forever discharge Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees, its/their heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or any of its affiliated individuals or organizations, no matter how designated or described, for any injury or damages, up to and including death, including but not limited to property damage to any personal property of which I may own, possess or have interest in, including without limitation all firearms, weapons, scopes, glasses, sighting devices and all other accessories pertaining thereto in any manner, and with shall include such injuries or damages from negligent acts, other acts, or omissions, howsoever cause, by any employee agent, representative or contractor of Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees or any of its affiliated individuals or organizations.  I hereby release and forever discharge Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees and any of its affiliated individuals, officers, directors, employees, contractors, attorneys, insurers or otherwise no matter how described or designated, from any and all causes of action, claims, demands, or attachment of property that I, my assignees, heirs, successors, distributes, guardian and legal representatives now have or may have for injury or damage, including property damage or loss, resulting in my participation in this or any other activity, even if said action claims, demands, or attachments are a result of acts of negligence, other acts or omissions, howsoever caused by an employee, agent, or contractor of Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees or any of its affiliated individuals or organizations.  I also agree to opt in to receive communication from Firearm Mentor via email, SMS messages, and other technologies.  I understand that I can unsubscribe at any time.

Hold Harmless

<![if !supportLists]>4.     <![endif]>I agree to indemnify and hold harmless Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees and any of its affiliated individuals and organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise, no matter how described or designated and without limitation, from any and all actions, suits, claims, demands, attachments, damages, expenses harm or destruction, suffered or accrued by or through me or anyone else which may result in any manner from my participation in the use of firearms, participation in filming or photography to be used as marketing materials. or otherwise pertaining to the use of Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees, even if said actions, claims, demands, damages, harm, or destruction are due partially or wholly from negligent acts, other action or omissions from Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees or any of its affiliated individuals or organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise, no matter how described or designated.  Should Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees or any of its affiliated individuals or organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise, no matter how described or designated, or anyone acting on their behalf, incur attorney’s fees and costs to enforce this agreement, I fully and completely indemnify and hold harmless for all such fees and costs. 

<![if !supportLists]>5.     <![endif]>I acknowledge that Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees or any of its affiliated individuals, organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise, no matter how described or designed, provides training only.  I also understand that there may be disqualifying events (from obtaining a variety of firearms licenses) that prevent me from obtaining government licensure (FOID, CCL, etc).  As such, the company does not provide licensure, nor does it have any influence over government issue licensure.  If I have a disqualifying event in my background, or if the licensure is not issued, I acknowledge that is wholly my issue and can pursue remedies against the issuing authority.

Financial Ability to Cover Injury or Damage

<![if !supportLists]>6.     <![endif]>I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in this activity, or else I agree to bear the full and complete costs of such injury or damage, myself.  I further certify that I have no medical condition or physical condition which could or would interfere with my safety in this activity, or else I am willing to fully assume and bear the costs of all risk that may be created directly or indirectly by such a condition (s). 

<![if !supportLists]>7.     <![endif]>By initialing and signing this document, I acknowledge that if I am injured or my property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Marcus Melnick, The Melnick Conglomerate, Firearm Mentor, and/or designees and/or any of its affiliated individuals or organizations, heirs, successors, assigns, agents, representatives, officers, directors, employees, contractors, attorneys, insurers or otherwise, no matter how described or designated on the basis of any claim which I have released them herein. 

<![if !supportLists]>8.     <![endif]>I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENT.  I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND MARCUS MELNICK, THE MELNICK CONGLOMERATE, FIREARM MENTOR, and/or designees AND ITS AFFILIATED INDIVIDUALS AND/OR ORGANIZATIONS AND OTHERS AS SET FORTH HEREIN.  IS SIGN IT OF MY OWN FREE WILL AND AGREE ON BEHALF OF MYSELF AND ALL OTHERS WHO MAY CLAIM BY AND/OR THROUGH ME TO BE BOUND AT ALL TIMES BY ITS TERMS.
